When determining a veteran’s disability rating for receiving VA benefits, the VA considers multiple factors about their condition and degree of disability.
While every condition is assessed separately on a VA disability claim to determine an overall disability rating, some impairments such as those occurring bilaterally, receive additional consideration.
This is referred to as the Bilateral Factor and for those receiving disability benefits, those meeting these criteria are assigned a higher disability rating.
What Is The Bilateral Factor for VA Disability Claims?
The bilateral factor for rating VA disability claims is when a veteran has an impairment that affects both arms, both legs, paired groups of muscles, or other bilateral impairments which result in a higher disability rating.
According to VA disability rating rules, because bilateral injuries or illnesses are much more limiting, they produce a higher level of disability.
Based on this rule, eligible veterans who meet bilateral disability criteria will receive a combined disability rating that is 10% higher than the two separate ratings combined.
What Criteria Are Required?
To qualify for a Bilateral Factor disability rating for increased VA benefits, a veteran must have an impairment that affects both upper limbs, lower limbs, or matching groups of muscles in some way that their ability to function is severely limited.
The conditions do not have to be directly related, but there must be bilateral impairment on both sides of the body to receive this additional consideration.
VA disability claims for new service-connected or secondary conditions that develop over time may eventually qualify a veteran for Bilateral Factor consideration.
How Is Bilateral Factor Calculated To Determine VA Benefits?
The formula used to calculate VA benefits under the Bilateral Factor rule is complex, as it considers everything from current bilateral impairments to how other conditions contribute to bilateral impairment.
Disability ratings are calculated as they normally would be; however, when bilateral impairment exists, those ratings are combined and an additional 10% rating is added.
Separately, Bilateral Factor ratings are added to other disability ratings to come up with a total overall rating when other disabilities exist.
In addition, qualifying VA disability benefits ratings must be calculated in two ways to ensure a veteran receives the highest rating possible based on a rule adjustment made earlier this year.
The VA will calculate using Bilateral Factor rules as well as by counting each impairment as a separate condition to avoid the occasional instance where the Bilateral Factor calculation results in a lower rating rather than a higher one.
